Warranty problem

Hello,
sir i bought a 8gb Kingston pen drive 1 year ago and 3months after i bought it it got an external scratch but it was working fine but
2months ago i inserted the pen drive in one of my friends PC full of virus
later i cleaned the pen drive in my system from that day
my pen drive is not getting detected when i insert it for the first time
i should re insert it again and again
at 5th or 6th time it gets detected later on it works fine
i checked for boot sector errors and all everything is fine but only it is not getting detected at the first time i insert
actually i gave the pen drive for replacement but due to the presence of scratch Kingston is not replacing my pen drive
so guys plzzzzzz help me out
