Who downloaded these files?

Hello,
I am not a massively computer literate person but my husband uses torrent sites to download various things from the internet. Recently I found some rather unsavoury files which had been added to the list to download but not actually downloaded yet. He swears blind that he did not put them there. Is there any way that they could have been downloaded without his knowledge? We have the usual anti virus software.
