Without having your laptop before the eyes, it is difficult to know what is the problem. The best solution is bringing it back to the person who sold it to you. Don't hesitate to require another one which works correctly.
As it is new, it is normally under warranty, but it depends on your country's laws.
If you open it or if you make any manipulation, you will lose the warranty
