Most of these 40 GB pen drives are counterfeit. They have at most 1 GB of real memory and a controller that has been reprogrammed to report 40 GB. After using the 1GB of memory any additional data is written at random in the existing space. See if you can get your money back.

Take it back where you bought it...don't struggle yourself trying to repair it.
