There might be some corrupted files on it causing the trouble and hence I will advise you to have it restored to factory settings in order to have the problem solved.

That's happens me alot too! Have you tried using an installer to "modify" your battery? If the answer is yes it ok the exact same happened to me. Have you tried jailbreakin or reprogrammin your iPod? That's messes it up too. Try turning it off then back on. Didn't work ... Sync it to iunes ... Didn't wor try resetting it
